Bespoke Projects / Packages
Here are the T&C’s for Bespoke Projects and Package options. It has been created to protect you (the client) and myself (Traci Salter of Designology). I recommend you read these terms before purchasing. By purchasing any service from Designology, you are agreeing to all terms and conditions below.
Please have a read over and let me know if you have any questions!
Overview
A bespoke quote or alternative package options will be given for larger or individual projects.
Assets
Before starting your project, you’ll need to have filled out the questionnaire and provided Designology with any assets (photos, images, illustrations, logos etc) and the text ahead of the kick-off call and before work can begin.
Payment
Bespoke projects can either be paid in full or split into an agreed amount of equal payments that will be spread over the project timeframe.
The first split payment is required before work begins. The project must be paid in full before final files are released. Work will not begin until the first payment is received.
Turnaround times
To ensure your project is delivered quickly and efficiently, I require your feedback for proofs within 5 working days. This allows me to move forward with your project and be able to deliver it promptly.
I will provide you with updated concepts within 5 working days from receiving your feedback.
5 working days turnaround excludes bank holiday, weekends and annual leave. If feedback is provided later than 5 working days hours, then your project may be delayed. There will also be an additional charge subject to rate changes.
Alternatively, if you feel you need a longer turnaround time, this can be agreed in our Kick-Off Call. However, the agreed deadlines must be adhered to otherwise other projects may then take priority and your project may be delayed.
If turnaround will take longer for unforeseen circumstances on either side, please communicate this at the earliest possible opportunity.
Turnaround time will begin once a split payment or payment in full has been received and a first proof date has been agreed and delivered.
Deadline and timeframes
During our initial kick-off call, both Designology and the client will agree on mutually realistic dates for deliverables.
If a client misses a deadline, this will impact any further allocated time slots, and your project will be delayed. You will then be rescheduled in at a time suitable for Designology.
If you think a deadline will be missed, please communicate this at the earliest opportunity to minimise impact.
If a faster delivery is required than initially agreed, an additional rush fee of £250 is required.
If a deadline is missed, an admin fee of £150 will be added to your next invoice to cover the cost of rescheduling your project.
Revisions
The number of changes will change depending on the project and will be listed in the proposal.
If you do require more than the allocated number of revisions, my hourly rate of £80p/h will be applicable. Work will not continue until I have your approval.
Additional costs
If your project requires stock images or anything that requires an additional cost, I’ll always let you know in advance and will only purchase after I receive your approval.
Deliverables
At the end of your project, I’ll always supply you with all files and images used for your records. Where possible, I’ll use free fonts that are suitable for commercial use and that you’ll be able to download onto your computer easily.
At the end of your project, I’ll always supply you with all files and images used for your records.
Where possible, I’ll use free fonts that are suitable for commercial use and that you’ll be able to download onto your computer easily. Note that I do not supply fonts due to licensing restrictions.
During our discovery or kick-off call, we can agree on dates for deliverables. If a faster delivery is required, an additional rush fee of £150 is required.
Scope creep
If a project changes direction after a brief has been given, this will impact the time spent on it.
Scope creep can include anything from pushing deadlines to adding extra pages. Any major structural change to a project is considered creep, as well as lots of small changes that can stall or derail a project such as:
• Incomplete design brief or information about a project
• Miscommunication about time or complexity of a project
• Moving forward without timelines or milestones
• Unexpected issues for the project, such as a brand change, company buyout, or new team vision
• Missing deliverables from the client to propel the design
• Low priority for project
• Hang-ups or communication issues in the design or editing process
Some design elements that may constitute scope creep include (if they aren’t part of the project from the onset):
• Needing new photos added to the design with each revision
• Creating new illustrations and elements from scratch
• Changing layout or image measurements / sizes
• Extensive Photoshop work
• Locating images and items for content
I will always aim to avoid / limit scope creep and additional costs by communicating any issues in advance. Please remember to give all information requested and if in doubt, let’s have a quick chat to go over any concerns.
Final files and proofs
Please check all proofs thoroughly including pricing, spelling and grammar, images and colours etc.
On sign off, you agree that you have checked spellings, fonts, images and the layout of the design in full. Once your design is finalised, any errors that require fixing will be chargeable.
Ownership
Upon completion and payment, you’ll have full ownership of your project and files. I will also hold a copy of your files for my records.
Permission
By purchasing any of my services, you agree for me to be able to showcase your work and testimonial on my website, social media and other platforms and means of advertisements.
If your work is data sensitive and cannot be shown for legal or client confidentiality reasons, please let me know and I am happy to sign an NDA.
Cancellation, refunds and expiry
If for any reason a project needs to be terminated, immediate notice via email is required before work has begun.
A non-refundable 50% deposit OR first equal payment is required to secure your project and slots. If you paid in full upon purchase then 50% will be refunded if termination is requested 48 hours or more from purchasing and before work has started. If work has begun, a refund is not available.
Projects can be paused at Designology’s discretion in certain circumstances. Please contact me privately to discuss.
No communication
After 30 days (including weekends) of no communication after proofs have been sent to the client, the project will be forfeited and no refund will be issued.
If the client wishes to restart the project after this time, it will be classified as a new project and will require an admin fee of £150 to reschedule the remaining work in.
Your project will also be delayed and you may end up having to wait longer than originally agreed.
Limitation of liability
Under no circumstances will either party be liable for any indirect, special, consequential, or punitive damages (including lost profits) arising out of or relating to this Agreement or the transactions it contemplates (whether for breach of contract, tort, negligence, or other form of action) in the event that such is not related to the direct result of one of the Parties’ negligence or breach.
